These Terms of Use ("Terms") govern your use of the Kit mobile application ("App") operated by APM Insights LLC ("we," "our," or "us"). By downloading or using Kit, you agree to these Terms. If you do not agree, do not use the App.
1. Not financial advice
Kit and Kit Advisor are personal finance organization tools, not professional financial advisors. Nothing in the App constitutes financial, investment, tax, legal, or other professional advice. Budget projections, savings calculations, investment growth estimates, and AI-generated content are for informational and organizational purposes only and should not be relied upon as the basis for financial decisions. APM Insights LLC is not a registered investment advisor, broker-dealer, financial planner, tax preparer, or attorney.
Everything Kit shows or generates, including budgets, projections, leave plans, estimates of tax credits or benefits, cost forecasts, and AI-generated content, is a general suggestion only. It is not an instruction, and it is not a recommendation that you take or avoid any particular action. Kit does not know your full financial situation. You decide what to do with your money, and using Kit does not create an advisory, fiduciary, or professional relationship of any kind.
For financial decisions involving investments, tax planning, estate planning, retirement accounts, or other significant matters, please consult a licensed financial professional.
2. No guarantee of accuracy
All AI-generated content in the App, including Kit Advisor responses, weekly check-ins, monthly recaps, and other AI features, is generated by artificial intelligence and may contain errors, inaccuracies, or outdated information. Financial projections and estimates in the App (including the 18-Year Generational Wealth Tracker and savings calculators) are based on assumptions and simplified models. Actual results will vary. Estimates of tax credits, employer or government benefits, and eligibility are approximate: rules, limits, and eligibility change over time and vary by state and employer, so please confirm the details with your employer, the relevant agency, or a licensed professional before acting on them. We make no representations or warranties as to the accuracy, completeness, or suitability of any content generated by the App.
3. Eligibility
You must be at least 18 years of age to use Kit. By using the App, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.
4. Subscriptions and billing
Kit offers a free tier and a premium subscription. Premium subscriptions are billed through your Apple ID on a monthly or annual basis. Subscription terms including pricing, trial periods, and renewal terms are displayed in the App at the time of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- Your Apple ID account will be charged upon confirmation of purchase
- Free trial periods, where offered, convert to paid subscriptions at the end of the trial unless cancelled
- Subscriptions are managed through Apple's App Store. To cancel, go to Settings on your iPhone, tap your name, then Subscriptions
- We do not offer refunds for partial subscription periods except as required by applicable law
5. User responsibilities
You are solely responsible for:
- The accuracy of any financial information you enter into the App
- Deciding whether and how to act on any suggestion, estimate, or information presented in the App, and any financial decisions you make as a result
- Keeping your device, and any backup or export files you create, secure
- Complying with all applicable laws in your use of the App
You agree not to use the App for any unlawful purpose or in any way that could damage, disable, or impair the App or servers supporting it.
6. Intellectual property
All content, design, code, and materials in the App are owned by APM Insights LLC or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written consent.
7. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APM INSIGHTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR FINANCIAL LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless APM Insights LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.
10. Governing law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Franklin County, Ohio.
11. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by updating the effective date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
